Here's a quick idea to help get most of the laws we're currently dealing with overturned: Simply prove beyond the shadow of a doubt that many common plants and animals (including ourselves) contain the molecule or its analogs. As in, framing research geared specifically to confirm this and have the evidence readily available. This wouldn't all have to be field research, as much as simply collecting previous field and medical research confirming this. This will turn out essential if any of the BBB case goes to the supreme court, and is not a light note by any means.

Bufotenine and DMT are found in human urine in normal individuals. Bufotenie is also found in some toads and many legumes. There are several papers that show that bufotenine is a normal part of the human metabolism. The Kansas state laws essentially outlaw human beings.

Bufotenine and N,N‐dimethyltryptamine (DMT) are hallucinogenic dimethylated indolethylamines (DMIAs) formed from serotonin and tryptamine by the enzyme indolethylamine N‐methyltransferase (INMT) ubiquitously present in non‐neural tissues. In mammals, endogenous bufotenine and DMT have been identified only in human urine. The DMIAs bind effectively to 5HT receptors and their administration causes a variety of autonomic effects, which may reflect their actual physiological function. Endogenous levels of bufotenine and DMT in blood and a number of animal and human tissues were determined using highly sensitive and specific quantitative mass spectrometric techniques. A new finding was the detection of large amounts of bufotenine in stools, which may be an indication of its role in intestinal function. It is suggested that fecal and urinary bufotenine originate from epithelial cells of the intestine and the kidney, respectively, although the possibility of their synthesis by intestinal bacteria cannot be excluded. Only small amounts of the DMIAs were found in somatic or neural tissues and none in blood. This can be explained by rapid catabolism of the DMIAs by mitochondrial monoamino‐oxidase or by the fact that the dimethylated products of serotonin and tryptamine are not formed in significant amounts in most mammalian tissues despite the widespread presence of INMT in tissues.

I think that there's a huge step that could be taken in this area if we had a police officer, a DA, a complicit "victim", and a defense lawyer for that "victim" all working for the cause.

The "victim" could be a grocer who sells poppy seeds, a baker who sells poppyseed muffins, a landscaping supplier who sells san pedro, a pet shop owner who sells mice, a gardener who grows morning glories, or any of a million different variations on that theme. Have the cop go in and ask them if they're aware their product contains the alkaloids in question. When they answer yes, the cop arrests them and the DA prosecutes them for distribution of a controlled substance.

In the trial, the court will be forced to either convict an obviously innocent person who differs from their peers only insofar as they are more educated about a product that's ubiquitously sold, or establish a precedent alleging the Controlled Substances Act to be unconstitutional.

Maybe it's a pipe dream, but it seems like the quickest way to get precedent on our side.

I think your onto something there Entropymancer. It sounds absurd, that absurdity is the reality of the current situation. In any case, the idea of using staged cases like this harkens to guerrilla theater, which can be an effective tactic in any sort of activism.
